Terms of Service

These Terms of Service (Terms) are an agreement between you and Leap Exam Pty Ltd (ABN 58 692 683 720) (Leap Exam, we, us, or our). They govern your use of the Leap Exam website, web app, and mobile apps (together, the Service).
By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. Who we are and what we offer
Leap Exam helps you prepare for English tests such as IELTS and PTE. We provide practice tests, automated scoring and feedback, study tools, and, for some plans, one-on-one tutoring.
Leap Exam is an independent study tool. We are not affiliated with, endorsed by, or connected to the owners or administrators of the IELTS or PTE tests, including the British Council, IDP, Cambridge, or Pearson. IELTS and PTE are trademarks of their respective owners, used here only to describe the tests we help you prepare for.
2. Practice scores are estimates, not official results
Scores, bands, and feedback from the Service are estimates produced by automated tools and, in some cases, our tutors. They are meant to help you practise and improve.
They are not official test results and do not guarantee any particular score on a real IELTS or PTE test. Your official result depends on the official test and its administrators. You should not rely on our estimates as a prediction or guarantee of your official outcome.
3. Your account
You can use some features as a guest. To use others, you need an account, which you can create with your email or through Google or Apple sign-in.
- You must give accurate information and keep it up to date.
- You are responsible for activity under your account and for keeping your login details secure.
- You must be at least 16 years old, or use the Service with the involvement of a parent or guardian.
- Tell us promptly if you think your account has been used without your permission.
4. Subscriptions, billing, and free access
Much of the Service is free to use. Some features, such as unlimited AI feedback, are part of a paid subscription (Leap Exam Pro).
Payments
On the web, payments are processed by Stripe. On our mobile apps, purchases are processed through the Apple App Store or Google Play. We do not store your full card details.
Renewal and cancellation
Paid subscriptions renew automatically for the same period until you cancel. You can cancel at any time, and your access continues until the end of the current billing period. For purchases made through an app store, you manage and cancel your subscription through that store's account settings.
Prices
Prices are shown before you buy. We may change prices, but a change will not affect a period you have already paid for. Unless stated otherwise, prices include GST where it applies.
5. Refunds
For subscriptions bought directly from us through Stripe, we offer a full refund if you request one within 30 days of your purchase. Contact us at hello@leapexam.com to request a refund.
Purchases made through the Apple App Store or Google Play are subject to that store's refund policy, and you should request those refunds through the store.
Nothing in this section limits any rights you have under the Australian Consumer Law (see Australian Consumer Law below).
6. Acceptable use
When you use the Service, you agree not to:
- Break any law, or infringe anyone else's rights.
- Copy, resell, scrape, or redistribute our test content or other materials, except as these Terms allow.
- Share your account, or use the Service on behalf of someone else without permission.
- Upload harmful, offensive, or unlawful content, or content that is not yours to share.
- Interfere with, disrupt, or try to gain unauthorised access to the Service or its systems.
- Use the Service to build a competing product, or to train a competing model, without our permission.
7. Your content
You keep ownership of the content you create through the Service, such as your speaking recordings and written responses (Your Content).
You grant us a licence to host, store, process, and analyse Your Content so we can provide the Service to you, including sending it to the service providers described in our Privacy Policy to generate scores and feedback. This licence ends when we delete Your Content, subject to normal backup cycles and our data retention practices.
8. Our content
The Service, including practice questions, feedback, software, text, design, and branding, is owned by Leap Exam or our licensors and is protected by intellectual property laws. We give you a personal, non-transferable, non-exclusive licence to use the Service for your own test preparation. You may not use our content for any other purpose without our permission.
9. Third-party services
The Service relies on third parties, such as Google and Apple for sign-in, Stripe and the app stores for payments, and cloud providers for hosting. Your use of those services may also be subject to their own terms. We are not responsible for third-party services we do not control.
10. Availability and changes to the Service
We work to keep the Service available and to improve it, but we may change, suspend, or discontinue features at any time. We may also update the Service for security, legal, or operational reasons. Except as required by law, we are not liable to you for changes to, or the unavailability of, the Service.
11. Disclaimers
To the extent permitted by law, the Service is provided on an as is and as available basis, without warranties of any kind. We do not warrant that the Service will be uninterrupted or error-free, or that its scores, feedback, or content are accurate or will improve your official test results.
12. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies those guarantees. Where we are allowed to limit our liability, our liability is limited, at our option, to resupplying the service or paying for it to be resupplied.
13. Limitation of liability
To the extent permitted by law, and subject to the Australian Consumer Law, Leap Exam is not liable for any indirect, incidental, or consequential loss, or for loss of profits, data, or opportunity, arising from your use of the Service. Our total liability to you for any claim is limited to the amount you paid us for the Service in the 12 months before the claim.
14. Suspension and termination
You can stop using the Service and close your account at any time. We may suspend or end your access if you breach these Terms, if the law requires it, or to protect the Service or other users. When your account ends, your right to use the Service stops, and we handle your information as described in our Privacy Policy.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date at the top and, where appropriate, notify you. Your continued use of the Service after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria. Nothing in these Terms limits rights you have under laws that apply to you and cannot be excluded.
